POSITION DETAILS
The Office of Facilities Planning, Construction, and Management (FPCM) for The City University of New York (CUNY) is responsible for the University's Capital Program which provides new facilities, renovations, and upgrades to the University's 300 buildings across 25 colleges and professional schools. FPCM's goal is to preserve the University’s campus assets, and when appropriate, expand the University's facilities portfolio, to meet 21st century demands. CUNY is embarked on a multi-billion dollar and multi-year capital design and construction program at its 25 campuses. FPCM fulfills its mission through the CUNY University Construction Fund (CUCF) which is a public benefit corporation created by the New York Education Law with the general mission to provide facilities with the necessary support to foster the educational mission of the City University of New York. Services are delivered by providing high quality, sustainable, and accessible facilities to meet the needs of the University, its constituent colleges and university stakeholders through design, construction, renovation and leasing of facilities; delivering facilities and facility projects on-time and on-budget using sound project management methods; ensuring maximum use of energy efficient and sustainable elements in building design, construction and renovation; maintaining the highest standards of business integrity and financial accountability through sound management and strong internal controls; establishing and maintaining analytic processes to identify budget needs to support the facility requirements for CUNY, its constituent colleges, and university stakeholders; and implementing and executing successful Minority- and Women Owned Business Enterprise and Service Disabled Veteran Owned Business programs.
Reporting to the Vice Chancellor of Facilities Planning, Construction, and Management, the University Deputy Executive Director of FPCM and General Counsel to the CUNY Construction Fund serves as the chief legal officer to the City University Construction Fund (CUCF).
Responsibilities include, but are not limited to:
- Advises the Vice Chancellor of FPCM on matters related to facility development, public-private partnership and real estate issues.
- Acts as the main liaison with other State and City entities such as the Office of the State Comptroller, Office of the Attorney General, City Corporation Counsel, Dormitory Authority of the State of New York Office (DASNY), Office of General Counsel, etc.
- Drafts and reviews agreements to support facility design and construction activities, including agreements with architects, engineers, construction managers, general contractors, trade contractors and other construction consultants.
- Drafts and reviews agreements, in conjunction with CUNY’s Office of the General Counsel (OGC), for the acquisition, disposition, leasing, and development of CUNY properties and facilities.
- Provides legal support and advice to the procurement department and program staff on procurement matters, including the development of RFPs, IFBs and other procurement documents, negotiation and documentation of change orders and contactor disputes; provides legal counsel and advice on a broad range of governance, authority and other matters.
- Manages the vendor integrity function, including investigations of fraud and other misconduct.
- Manages claims and litigation matters, including construction claims and other liability claims as well as those administered by insurance carriers, and supervises outside counsel.
- Serves as the department’s internal controls, ethics and FOIL officer.
- Provides advice and support on sustainability issues, including negotiating and drafting agreements for sustainable energy developments and other energy efficiency and sustainability efforts.
- Drafts Board Resolutions related to Facilities Planning, Construction and Management.
Note: Until further notice, this is a hybrid position, eligible to work remotely and work in the office.
QUALIFICATIONS
Minimum:
This position is in CUNY's Executive Compensation Plan. All executive positions require a minimum of a Bachelor's degree and eight years' related experience.
Not with standing the foregoing, all applicants for this position must possess the following qualifications:
- JD from an accredited law school
- Membership in good standing in the New York State Bar
- Fifteen or more years of progressively responsible legal experience as a practicing attorney
Preferred:
- Significant facilities experience including in design, construction, development, real estate, leasing, sustainability and procurement, particularly in the public sector
- Experience in developing, drafting, negotiating, and administering agreements for design, construction, development, real estate, and leasing
- Experience with public sector entities and their operations, including governance, financing, operations, legislation and regulations
- Experience with New York State Procurement laws and their implementation through regulations, guidance and oversight from entities such as the Office of the State Comptroller, Office of the Attorney General, and Office of General Services
- Strong analytical, evaluation, and research skills
- Exceptional communication and interpersonal skills with a demonstrated ability to work effectively, collaboratively, and cooperatively with diverse stakeholders, constituents, and clients of various levels
- Strong negotiation, contract drafting, conflict resolution, and client counseling skills
- Significant experience interpreting laws, drafting and interpreting organizational regulations, policies, procedures, and guidelines
- Ability to produce results as an individual contributor and part of a team
- Ability to take initiative, exercise discretion and tact, and use sound judgment to give advice and make decisions
- Strong organizational skills with the ability to establish plans, manage a large workload and multiple assignments, and meet deadlines in a fast-paced office
- Proficiency using standard office programs (Word, Excel, PowerPoint, Outlook, SharePoint), virtual meeting and collaboration tools (MS Teams, Zoom, WebEx) and legal research software (Westlaw, Lexis)

COMPENSATION AND BENEFITS
The salary range is $200,000 - 225,000; commensurate with qualifications, experience, and education.
